Guest Release & Consent (Summary)

By participating in and/or appearing on any podcast episode, webinar, digital event, interview, recording, livestream, or related content produced by Healthy Mind by Avik™ and/or Digitimes Pvt Ltd (collectively, “Producer,” “we,” “us,” “our”), the guest and/or the guest’s authorized representative/agency (“Guest,” “you”) agrees as follows:

1) Recording, Editing, and Use Rights

You grant the Producer an irrevocable, worldwide, perpetual, royalty-free right and license to record, photograph, film, edit, translate, transcribe, adapt, distribute, publicly perform, publicly display, publish, syndicate, and otherwise use the content of your participation, including your name, likeness, voice, biographical information, and statements, in whole or in part, in any media now known or later developed, for editorial, promotional, marketing, and distribution purposes.

You understand and agree the Producer may edit for length, clarity, safety, and production quality, and you waive any right to approve the final edited version, except where prohibited by law.

2) No Obligation to Remove Published Episodes

Once an episode/content is recorded and/or published, you acknowledge that the Producer is not obligated to remove, retract, delete, or take down any content in response to any request by the Guest or any agency/representative, for any reason, including but not limited to changes in personal preference, reputation concerns, new affiliations, or messaging changes.

The Producer may, at its sole discretion, consider removal or modification requests; however, any such action is a business decision, not an obligation.

3) Removal/Down-Edit Request Fee (Administrative + Revenue Impact)

If the Producer agrees (in its sole discretion) to remove an episode, unpublish content, or materially edit/down-edit content after publication at the request of the Guest or the agency/representative, you agree to pay a non-refundable administrative and opportunity-cost fee of USD $100 to help offset operational time and potential advertising/sponsorship impacts.

This fee is not a penalty; it is an administrative charge intended to partially cover internal costs and potential lost revenue. The Producer may also require additional reimbursement if there are documented third-party costs (e.g., sponsor make-goods, platform costs), but only if communicated in writing.

4) Guest Representations & Warranties

You represent and warrant that:

• You have full authority to grant these rights and to enter into this consent (and if submitting through an agency, the agency confirms it is authorized to act on your behalf).

• Your participation and any materials you provide (including slides, images, audio, brand assets, stories, or references) do not infringe or violate any third-party rights (copyright, trademark, privacy, publicity, confidentiality, or contract).

• You will not knowingly provide false or defamatory statements, and you accept responsibility for the accuracy of statements you choose to make.

5) Third-Party References & Fair Use

You acknowledge the Podcast may discuss third-party products, services, brands, organizations, public figures, professions, and countries as part of commentary and discussion. Any third-party media remains the property of its respective owners and, where used, is intended for commentary and informational purposes consistent with applicable “fair use/fair dealing” principles.

6) Disclaimer and Limitation of Responsibility

This episode is for educational and informational purposes only and is not medical, mental health, legal, or professional advice. The views expressed by the Guest are the Guest’s personal opinions and do not necessarily reflect the views of the host, Healthy Mind by Avik™, Digitimes Pvt Ltd, or any team member, affiliate, contractor, or partner.

To the fullest extent permitted by law, you agree that the Producer, its host(s), team, contractors, and affiliates:

• are not responsible for how your statements are interpreted, shared, excerpted, or responded to by listeners or third parties,

• do not make any warranties about outcomes, results, or audience actions arising from the episode,

• do not intend to harm, defame, or discredit any person, organization, brand, product, country, or profession mentioned.

By participating, you acknowledge and accept this disclaimer.

7) Release of Claims

To the maximum extent permitted by applicable law, you release and discharge the Producer, its host(s), employees, contractors, affiliates, and partners from any claims arising out of or related to the recording, editing, publication, distribution, or promotion of the content, including claims relating to privacy, publicity, defamation, misrepresentation, or moral rights—except where such waiver is prohibited by law.
